The lawsuit was filed by Oliver L., a decreased man from Florida who was injured by the Celect® Inferior Vena Cava Filter (“IVC Filter”) manufactured by Cook Medical LLC and William Cook Europe ApS.
The IVC Filter was surgically implanted in his vein to catch blood clots on July 31, 2016 at North Florida Regional Medical Center in Gainesville, Florida by Dr. Bret N. Wiechmann.
Cook Medical is accused of negligence for selling a defective medical device and failing to warn about safety risks.
The lawsuit was filed on July 31, 2018 in the U.S. District Court for the Southern District of Indiana (Indianapolis Division) — Case No. 1:18-cv-02330-RLY-TAB.
It will be centralized with over 4,350 other IVC filter lawsuits now pending in Multi-District Litigation (MDL No. 2570) — In Re: Cook Medical, Inc., IVC Filters Marketing, Sales Practices, and Products Liability Litigation.
