The lawsuit was filed by David A., a man from Florida who was injured by the Celect® Inferior Vena Cava Filter (“IVC Filter”) manufactured by Cook Medical and William Cook Europe ApS.
The IVC Filter was implanted on January 28, 2015 at Moffit Cancer Center in Tampa, Florida by Dr. Jennifer Sweeney.
Cook Medical is accused of negligence for selling a defective medical device and failing to warn about safety risks.
The lawsuit was filed on March 13, 2018 in the U.S. District Court for the Southern District of Indiana (Indianapolis Division) — Case No. 1:18-cv-00801-SEB-DML.
It will be centralized with over 3,700 other IVC filter lawsuits that have already been filed against Cook Medical in a federal Multi-District Litigation in Indiana (MDL No. 2570) — In Re: Cook Medical, Inc., IVC Filters Marketing, Sales Practices, and Products Liability Litigation.
The plaintiff is represented by Ben C. Martin and Thomas Wm. Arbon of The Law Offices of Ben C. Martin.
