The lawsuit was filed by Eric T. J., a man from Tennessee who was injured by the Günther Tulip® Inferior Vena Cava Filter (“IVC Filter”) manufactured by Cook Medical LLC and William Cook Europe ApS.

The IVC Filter was implanted on June 1, 2011 at Skyridge Medical Center-Main in Cleveland, Tennessee by Dr. Martin J. Carignan.

The IVC Filter was implanted for the purpose of preventing a Venous Thromboembolism (VTE). The plaintiff’s injuries occurred while he was living in Colorado, the state where he is currently a resident.

Cook Medical is accused of negligence for selling a defective medical device and failing to warn about safety risks.

The lawsuit was filed on April 18, 2018 in the U.S. District Court for the Southern District of Indiana (Indianapolis Division) — Case No. 1:18-cv-01171-RLY-MPB.

It will be centralized with over 4,000 other IVC filter lawsuits that have already been filed in Multi-District Litigation (MDL No. 2570) — In Re: Cook Medical, Inc., IVC Filters Marketing, Sales Practices, and Products Liability Litigation.
