The lawsuit was filed by Autumn O., a woman from Louisiana who was injured by the Günther Tulip® Inferior Vena Cava Filter (“IVC Filter”) manufactured by Cook Medical LLC and William Cook Europe ApS.
The IVC Filter was implanted in 2007 at Terrebone General Medical Center in Houma, Louisiana for the purpose of preventing a Venous Thromboembolism (VTE) or blood clots in her lungs.
Cook Medical is accused of negligence for selling a defective medical device and failing to warn about safety risks.
The lawsuit was filed on May 11, 2018 in the U.S. District Court for the Southern District of Indiana (Indianapolis Division) — Case No. 1:18-cv-01458-RLY-TAB.
It will be centralized with over 4,000 other IVC filter lawsuits that have already been filed in Multi-District Litigation (MDL No. 2570) — In Re: Cook Medical, Inc., IVC Filters Marketing, Sales Practices, and Products Liability Litigation.
