The lawsuit was filed by Paulette T., a woman from Montana who was injured by the Denali® Inferior Vena Cava Filter (“IVC Filter”) manufactured by C.R. Bard and Bard Peripheral Vascular Inc.
The IVC Filter was implanted on May 19, 2016 at a hospital in Montana. Her injuries occurred while she was living in Montana.
C.R. Bard is charged with negligence, strict products liability, failure to warn, design defect, manufacturing defect, failure to warn, breach of express and implied warranty, fraudulent misrepresentation and concealment, and punitive damages.
The lawsuit was filed on April 1, 2018 in the U.S. District Court for the District of Arizona — Case No. 2:18-cv-01005-DGC.
It will be centralized with over 3,600 other IVC filter lawsuits now pending against C.R. Bard in Multi-District Litigation (MDL No. 2641) — IN RE: Bard IVC Filters Products Liability Litigation.
