The lawsuit was filed by Lynda K. S., a woman from Texas who was injured by the Günther Tulip® Inferior Vena Cava Filter (“IVC Filter”) manufactured by Cook Medical LLC and William Cook Europe ApS.

The IVC Filter was implanted on December 26, 2014 at Texas Health Southwest Hospital in Fort Worth, Texas by Dr. R. Gray Chilcoat for the purpose of preventing a Venous Thromboembolism (VTE).

Cook Medical is accused of negligence for selling a defective medical device and failing to warn about safety risks.

The lawsuit was filed on April 19, 2018 in the U.S. District Court for the Southern District of Indiana (Indianapolis Division) — Case No. 1:18-cv-01193-TWP-MPB.

It will be centralized with over 4,000 other IVC filter lawsuits that have already been filed in Multi-District Litigation (MDL No. 2570) — In Re: Cook Medical, Inc., IVC Filters Marketing, Sales Practices, and Products Liability Litigation.

The plaintiff is represented by Ben C. Martin of The Law Offices of Ben C. Martin in Dallas, Texas.
