The lawsuit was filed by Nicole T., a woman from Ohio who was injured by the Celect® Vena Cava Filter (“IVC Filter”) manufactured by Cook Medical LLC and William Cook Europe ApS.
The IVC Filter was surgically implanted in her vein to catch blood clots on January 8, 2010 at Akron Children’s Hospital in Akron, Ohio by Dr. Carl Martino.
Cook Medical is accused of negligence for selling a defective medical device and failing to warn about safety risks.
The lawsuit was filed on March 20, 2019 in the U.S. District Court for the Southern District of Indiana (Indianapolis Division) — Case No. 1:19-cv-01120-TWP-DML.
It will be centralized with over 5,200 other IVC filter lawsuits now pending against Cook Medical in Multi-District Litigation (MDL No. 2570) — In Re: Cook Medical, Inc., IVC Filters Marketing, Sales Practices, and Products Liability Litigation.
