The lawsuit was filed by Luis C., a man from Florida who was implanted with the Celect® Inferior Vena Cava Filter (“IVC Filter”) manufactured by Cook Medical LLC and William Cook Europe ApS.
The IVC Filter was surgically implanted in his vein to catch blood clots on May 4, 2012 at Memorial Regional Hospital in Hollywood, Florida by Dr. Rafael Sanchez.
The lawsuit accuses Cook Medical of failing to warn about safety risks, selling a defective medical device, negligence, and more.
The lawsuit was filed on March 13, 2018 in the U.S. District Court for the Southern District of Indiana (Indianapolis Division) — Case No. 1:18-cv-00807-WTL-MPB.
It will be centralized with over 3,800 other IVC filter lawsuits that have already been filed in Multi-District Litigation (MDL No. 2570) — In Re: Cook Medical, Inc., IVC Filters Marketing, Sales Practices, and Products Liability Litigation.
