The lawsuit was filed by Donald O., a man from Alabama who was injured by the Meridian® Inferior Vena Cava Filter (“IVC Filter”) manufactured by C.R. Bard and Bard Peripheral Vascular Inc.
The IVC filter was surgically implanted for the purpose of preventing a pulmonary embolism (blood clot in the lungs).
It was implanted on May 18, 2012 at a hospital in Florida. The plaintiff was a resident of Florida when his injuries occurred.
The lawsuit accuses C.R. Bard of negligence, manufacturing defect, design defect, failure to warn, negligent misrepresentation, breach of express and implied warranty, fraudulent misrepresentation, fraudulent concealment, and punitive damages.
The lawsuit was filed on March 30, 2018 in the U.S. District Court for the District of Arizona — Case No. 2:18-cv-00992-DGC.
It will be centralized with over 3,600 other IVC filter lawsuits pending against C.R. Bard in a federal Multi-District Litigation in Arizona (MDL No. 2641) — In Re: Bard IVC Filters Products Liability Litigation.
