The lawsuit was filed by Judith C., a woman from Pennsylvania who was injured by the Günther Tulip® Vena Cava Filter (“IVC Filter”) manufactured by Cook Medical LLC and William Cook Europe ApS.
The IVC Filter was implanted on May 17, 2016 at Lehigh Valley Interventional Radiology in Allentown, Pennsylvania by Dr. Dana R. Burke for the purpose of preventing a Venous Thromboembolism (VTE).
Cook Medical is accused of negligence for selling a defective medical device and failing to warn about safety risks.
The lawsuit was filed on October 31, 2018 in the U.S. District Court for the Southern District of Indiana (Indianapolis Division) — Case No. 1:18-cv-03356-TWP-DML.
